Madrid tourist rental requirements: a guide for property owners

Tourism requirements, planning rules, building approval and guest reporting: what to check before operating a Madrid rental.

Mauro Forchino · 29 October 2026 · 2 min read

Before listing a Madrid property, confirm that the specific home can legally operate as a tourist rental. Tourism registration, planning authorisation and building rules are separate checks. This guide is general information, not legal advice.

1. Check the rules for the exact address

Check the current Community of Madrid tourism requirements, Madrid City Council planning conditions and your building’s applicable rules. Tourism registration does not replace other authorisations. Consult the latest official guidance.

2. Review your building’s rules

Read the bylaws and meeting minutes and check what approval is required under the current Horizontal Property Act. Requirements can depend on when the activity started and the circumstances of the property. Obtain case-specific legal advice.

★★★★★ · Airbnb

“Todo impecable y tal cual se ve en las fotos. Respondieron rápido siempre y la zona muy buena, tranquila y linda.”
— Lucas

3. Distinguish the registrations

The Community of Madrid provides a responsible-declaration procedure for tourist accommodation. This is separate from the national unique registration number for short-term rentals marketed through platforms. Check the scope and requirements of each process; neither replaces the other.

4. Guest reporting

Spain’s Interior Ministry distinguishes duties to collect, record and communicate traveller information. Consult SES Hospedajes guidance for the information, deadlines and obligations applicable to your activity rather than assuming a daily submission is sufficient.

★★★★★ · Airbnb

“Desde el primer momento me sentí como en casa. Todas las habitaciones estaban limpias y muy bien decoradas. Mauro fue amable, comunicativo y siempre trató de asegurarse de que estuviera bien.”
— Jamila

5. Before investing

Confirm planning eligibility before spending on refurbishment. Check insurance, tax obligations and registration requirements with the appropriate authorities or qualified advisers.
